1. Agreement to Terms

These Terms of Service ("Terms") govern your use of Plagiarism Checker AI ("Service", "we", "our", "us"), including our website, API, and all related services. By accessing, using, or registering with our Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Service.

We may modify these Terms at any time. Continued use of the Service following changes constitutes acceptance of the updated Terms. We will notify users of material changes via email or by posting a notice on our website.

2. Acceptable Use Policy

You agree not to use our Service for any unlawful, harmful, or abusive purposes, including:

  • Submitting illegal content or content that violates third-party rights
  • Using the Service to help plagiarize or commit academic fraud
  • Attempting to circumvent rate limits, authentication, or security controls
  • Submitting content containing malware, viruses, or exploits
  • Reverse-engineering, decompiling, or disassembling the Service
  • Using the Service in a way that damages or disables our infrastructure
  • Scraping, crawling, or harvesting our results without permission
  • Reselling API access without authorization
  • Submitting private data, credentials, or personally identifiable information of others

Violations of this policy may result in immediate suspension or termination of your account without refund.

3. User Accounts and Responsibility

Account Creation. To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary.

Account Security. You are responsible for maintaining the confidentiality of your password, API keys, and account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for unauthorized access resulting from your failure to secure your credentials.

Acceptable Conduct. You agree that your account will not be used to:

  • Engage in harassment, abuse, or discrimination
  • Submit content that is obscene, defamatory, or invasive of privacy
  • Violate academic integrity policies if you are a student or educator
  • Impersonate another person or entity

4. Content and Intellectual Property

Your Content. You retain all intellectual property rights to content you submit to our Service ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive license to process, analyze, and store it solely to provide the Service to you.

Data Retention. Your submitted text is NOT permanently stored in our database. After your scan completes, the text is removed from our active processing systems within 24 hours. Scan results (plagiarism score, detected sources, highlights) are retained for 30 days or until you delete your account, whichever comes first. See our Privacy Policy for complete retention details.

Service Content. All content, features, and functionality of the Service (including our detection algorithm, user interface, documentation, and brand materials) are owned by us or our licensors and are protected by copyright and other intellectual property laws. You may not reproduce, distribute, or modify this content without permission.

No Copying for AI Training. You agree not to use our Service results, sources, or highlighted matches to train AI models, machine learning systems, or language models without explicit written permission from Plagiarism Checker AI.

5. API Usage Terms

API Access. If you are an API user, you agree to:

  • Use the API only for the purpose stated in your account plan
  • Comply with rate limits specified for your plan (Free: 10 rpm, Creator: 20 rpm, Professional: 60 rpm, Department: 100 rpm, Institution: 200 rpm)
  • Not exceed the character limit for text submissions per your plan
  • Not share API keys with unauthorized third parties
  • Not attempt to bypass authentication or circumvent usage restrictions

Monitoring. We reserve the right to monitor API usage to detect abuse, enforce rate limits, and maintain service stability. Excessive or abusive API usage may result in throttling, temporary suspension, or permanent termination of API access without refund.

Deprecation. We may deprecate API endpoints with 30 days' notice via email and posted on our API documentation page.

6. Limitation of Liability

AS-IS Service. The Service is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Service's accuracy, completeness, reliability, or fitness for a particular purpose.

No Liability for Detection Results. Our plagiarism detection algorithm is based on statistical analysis and may not catch all plagiarism or may produce false positives. We do not guarantee 100% accuracy. Users are responsible for independently verifying results and conducting additional research as needed.

Indemnification. You agree to indemnify and hold harmless Plagiarism Checker AI, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your content or submissions
  • Your violation of any law or third-party rights

Limitation of Damages. To the fullest extent permitted by law, Plagiarism Checker AI shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, even if we have been advised of the possibility of such damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

No Warranty of Results. We do not guarantee that plagiarism detection will result in specific outcomes, academic penalties, or enforcement actions. The Service provides information for your reference only.

7. Service Availability and Uptime

We commit to maintaining 99.5% uptime for the Service on a monthly basis, measured from our infrastructure providers' logs. Downtime does not include scheduled maintenance or third-party outages beyond our control.

We may temporarily suspend the Service for maintenance, security updates, or emergency repairs. We will notify users of scheduled maintenance via email when possible. Unscheduled maintenance is performed as quickly as possible with minimal notice.

During periods of high demand or system overload, we may temporarily throttle requests or place API calls in a queue. Queued requests are processed in the order received.

8. Payment Terms

Paid Plans. If you purchase a paid plan, you agree to pay the stated subscription price plus applicable taxes. Billing occurs monthly or annually depending on your selected plan.

Credits and Refunds. Credits are non-refundable and expire 30 days after the start of your billing period. Unused credits do not carry over to future periods. Refunds are issued at our discretion within 30 days of your request, provided the Service was not used beyond fair use limits.

Cancellation. You may cancel your subscription at any time from your Account Settings. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months.

Price Changes. We may change our pricing with 30 days' notice via email. Continued use of the Service constitutes acceptance of new pricing.

9. Termination

Termination by You. You may terminate your account at any time by deleting your account from your Account Settings. Your data will be permanently deleted within 30 days.

Termination by Us. We may suspend or terminate your account immediately and without refund if:

  • You violate these Terms or our Acceptable Use Policy
  • You engage in abusive behavior toward us or other users
  • Your account is used to commit fraud, illegal activity, or academic misconduct
  • We reasonably believe your account poses a security risk to our Service or other users
  • You fail to pay subscription fees for more than 30 days after the due date

Upon termination, your account and associated data will be deleted. No refunds are issued except as required by law.

10. Governing Law and Dispute Resolution

Governing Law. These Terms are governed by and construed in accordance with the laws of Delaware, USA, without regard to its conflict of law provisions.

Jurisdiction. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Delaware for any dispute arising from these Terms or the Service.

Dispute Resolution. Before pursuing legal action, you agree to attempt to resolve disputes through good-faith negotiation. If negotiation fails, either party may pursue arbitration through JAMS (Judicial Arbitration and Mediation Services) in Delaware. Arbitration shall be conducted by a single arbitrator under JAMS rules, with costs split equally.

No Class Action. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative action.

11. Entire Agreement and Severability

These Terms, together with our Privacy Policy and other policies referenced herein, constitute the entire agreement between you and Plagiarism Checker AI regarding the Service and supersede all prior agreements, negotiations, and understandings, whether written or oral.

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, and the remaining provisions shall continue in full force and effect.
